I have said this in previous blog posts, but it’s worth repeating for emphasis.
The simplest and best way to preserve the evidence of defect in your lemon vehicle, and thus better ensure a successful outcome for your lemon law case, is to video the defect. After you make the video, have it stored onto a CD and make copies. Your attorney will need one for himself, and will likely need one for any expert you may hire, as well as one for the other side.
A few tips:
- Don’t talk during the videos. Your comments on tape can actually result in the tape being excluded from evidence. Keep silent. You can always describe what you are seeing as the video is playing during a trial or other hearing.
- If you don’t know how to video, or transfer the video onto a CD, ask a local teenager. They seem to know all about this stuff. It’s not that hard. A call to any local high school will provide you with names of kids who will do the work for you, either for free or for a cheap price.
- To the extent possible, make a quality video, not a cheap one. Use a better camera instead of a cellphone, but if you only have a cellphone, make sure that the lighting, etc. is good so that you can capture a good video reproduction of the defect.
